By consent of both parties, the Writ Petition is taken up for final hearing at the admission stage itself.
2. This petition has filed forbearing the respondents 3 and 4 not to given electricity connection in the 5th respondent plot No.102, First Cross Street, DNV Nagar, Vellagounder Palayam Village, Kumarasamypettai, Dharmapuri District based on the petitioner representation dated 22.04.2023.
3. It is the case of the petitioner that the petitioner is the owner of the land in S.No.347, 348 in Vellagounder Palayam Village, First Cross Street, DNV
Nagar, Kumarasamypettai, Dharmapuri District. The 5th respondent is the adjacent land owner and he made an application before the 4th respondent for getting electricity connection, for which, the 4th respondent erected electric pole in front of the petitioner's plot. On 22.04.2023, the petitioner made a representation to the 4th respondent requesting to remove the said electric pole erected in front the petitioner's plot, but no action is taken so far and hence, the present writ petition has filed.
4. The learned counsel for the petitioner submitted that this Court may direct the 4th respondent to consider the petitioner's representation and pass appropriate orders within the time stipulated by this Court.
5. Heard the learned counsel for the petitioner and the learned Government Counsel appearing on behalf of the respondents and perused the materials available on record. Since no adverse orders are passed against the 5th respondent and hence, notice to the 5th respondent is dispensed with.
6. Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this Court
directs the 4th respondent to consider the representation of the petitioners dated 22.04.2023 and pass appropriate orders on merits and in accordance with law, after providing opportunity to the petitioner as well as the 5th respondent within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 28.04.2023 rli To
