JUDGMENT

It is reported by the learned counsel for the first respondent that, despite his best efforts, he was unable to obtain instructions from the client regarding the steps to be taken in respect of the deceased second respondent.

2. This Court had already recorded the same submission on an earlier occasion and adjourned the matter finally.

3. When the matter was taken up for hearing today, the learned counsel for the first respondent reiterated the same submission, and there was also no representation on behalf of the appellants.

4. In view of the fact that the matter has been pending without any progress, the Second Appeal is dismissed for non-prosecution. There shall be no order as to costs. Consequently, the connected miscellaneous petition stands closed.
