The petitioner, who was arrested and remanded to judicial custody on 01.03.2023 for the alleged offences under Sections 294(b), 323, 307 and 506(ii) of IPC in crime No.715 of 2022 on the file of the respondent police, seeks bail.

2. It is the case of the prosecution that the defacto complainant, who is working as Water Board Lorry Driver in Vyasarpadi area, on 25.09.2022 around 1.30 a.m., was sleeping in the lorry. At that time, the petitioner and other accused persons, due a wordy quarrel, attacked him causing injuries. 3.The learned counsel appearing for the petitioner would submit that the petitiner is an innocent person and he has been falsely implicated in this case. Hence, he seeks for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor would submit the petitioner is arrayed as A3 in this case. When the accused were consuming 'ganja', it was questioned by the victim, pursuant to which the victim was attacked by them with deadly weapons, thereby he sustained injuries. Hence, he vehemently objected for grant of bail to the petitioner.

5. It is seen that there are totally three accused, in which the petitioner is arrayed as A3. When they were consuming 'ganja' near metro water tank, it was questioned by the victim, pursuant to which he was attacked by the accused persons with deadly weapons. Therefore, the victim sustained injuries. That apart, the petitioner is a history sheeter having 18 previous cases. Therefore, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this criminal original petition is dismissed. 05.05.2023 lok
