Venkata Reddy ..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Certiorarified Mandamus, calling for the records relating to (i) the impugned fraudulent Sale Deed bearing document No. 3186 of 2008 (ii) the impugned fraudulent Rectification deed bearing Document No. 1158 of 2009 on the file of the 3rd respondent executed in favour of the 4th respondent in respect of S.No. 46/1A2A and S.No 46/1B1A situated at Panchakshipuram Village, Hosur Taluk, Krishnagiri district and quash the same as being fraudulent, void ab initio, and non-est in law consequently direct the 3rd respondents to delete the entry or neutralising the fraudulent by separate entry in the encumbrance certificate index, within the stipulated period fixed by this court.

The learned counsel for the petitioner seeks liberty for the petitioner to approach the Civil Court for removal of entries as prayed for in this Writ Petition. He has also made an endorsement to that effect in the court bundle. 2.Since the relief sought for cannot be granted in a Writ Petition, the petitioner seeks for liberty to approach the Civil Court. 3.As per the endorsement made by the learned counsel for the petitioner, this Writ Petition is disposed of by granting liberty to the petitioner to approach the Civil Court for the reliefs prayed for in this Writ Petition. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
