PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the second respondent to register the sale deed bearing Temporary No.TP/213777902/2025 dated 19.03.2005 executed by the petitioners in favour of Mr.Govindaraj and pass orders. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of mandamus to direct the second respondent to register the sale deed bearing Temporary No.TP/213777902/2025 dated 19.03.2005 executed by the petitioners in favour of Mr.Govindaraj.
3. It is submitted by the learned counsel for the petitioners that property comprised in Survey No.46/9, measuring an extent of 0.04 cents situated at 2/6
Bhoothamoor Village, Vriddhachalam Taluk, Cuddalore District is the ancestral property of the petitioners. On 19.03.2025, the petitioners executed a sale deed in favour of one Govindaraj, in respect of the subject property and presented before the fourth respondent for registration. The fourth respondent without assigning any reason returned the sale deed and did not pass a refusal order. Hence, the petitioner has filed the present writ petition.

At the outset, it was submitted by the learned Special Government Pleader the petitioner may re-present the sale deed dated 19.03.2025 and the same would be registered, if it is otherwise in order, If, for any reason, the Sub Registrar is of the view that the registration ought to be refused, he would do so after assigning reasons, which was agreed to by the learned counsel for the petitioner.

In view thereof, it is open to the petitioner to re-present the sale deed dated 19.03.2025 and if any such sale deed is re-presented, respondent shall register the sale deed, if it is otherwise in order. If for any reason, the respondent refuses to register the sale deed, he shall assign reasons in the refusal order, which was agreed to by both counsel for petitioner as well as respondents. It is made 3/6
clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
5. Recording the above, the writ petition stands closed. There will be no order as to costs.
