2023-04-28Honourable Mr Justice S. Vaidyanathan,Honourable Mrs Justice R. Kalaimathi1 pages

C.M.P.Nos.10169, 10159 and 10171 of 2023 and 10162 of 2023 in A.S.SR.Nos.138785, 138784, 138783 of 2022 and 139195 of 2022 S.VAIDYANATHAN,J.

and R.KALAIMATHI ,J.

These matters have been listed today under the caption "For Being Mentioned".

2. Civil Miscellaneous Petition Nos.10169, 10159 and 10171 of 2023 have been filed for condonation of delay, whereas C.M.P.No.10162 of 2023 has been taken out for grant of leave to file an appeal. Admittedly, all these petitions were listed for hearing altogether on 28.04.2023.

3. Normally, the petition to grant leave would be allowed at the first instance and thereafter, the petition for condoning the delay would be ordered. In these cases, this Court had allowed all Civil Miscellaneous Petitions on 28.04.2023, including the one filed to grant leave, viz., C.M.P.No.10162 of 2023. However, the said petition has not been included in the interim order dated 28.04.2023 and the petition was left out without any order. Hence, Registry is directed to include C.M.P.No.10162 of 2023 in the earlier order dated 28.04.2023, as the same was ordered on the said date itself along with other Civil Miscellaneous Petitions.
