JUDGMENT

(Delivered by M.M.SUNDRESH.,J) Challenging the order dated 12.02.2018 passed in I.A.No.2454 of 2013 in O.P.No.631 of 2013 on the file of the V Additional Family Court, Chennai, the present appeal has been filed. 2.Today, the matter has been posted for recording compromise. On the earlier occasion, no such compromise could be recorded on two aspects namely duration for the agreed payment and the interim maintenance to be paid till such time. 3.Both parties are present today. In the presence of both parties, it is agreed that the agreed payment will have to be complied with by the appellant. Further, the appellant will have to pay a sum of Rs.13,000/- per month from the month of December, 2019 and thereafter. This arrangement would continue till the completion of the schedule as mentioned. An affidavit dated 13.12.2019 is filed by the appellant. also further agreed to meet the educational expenses of the children. The averments made by the appellant in para 7 of the affidavit stands recorded:

7.I further submit that I will try to give the amount in time. Nowadays I could not mobilize funds from my neighbours. So I hereby give the following undertaking. I have already given Rs.1,50,000/- to the respondent. I have to pay the balance amount of Rs.8,50,000/- to the respondent.

(i) I hereby undertake to give Rs.2,00,000/- in the first week of June, 2020, Rs.1,50,000/- in the first week of December,2020, Rs.1,50,000/- in the first week of June,2021, Rs.1,50,000/- in the first week of December,2021, Rs.2,00,000/- in the first week of June,2022, if this Hon'ble Court approves the same. I further undertake that if I get any amount, I will pay the total amount to the respondent.

4.It is further agreed between the parties at the time of completion of the terms as recorded above, the respondent would agree for mutual divorce. The Civil Miscellaneous Appeal stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
