This petition has been filed seeking to extend the time limit for completion of the examination of defense witnesses permitted by this Court in Crl.O.P.No.8599 of 2019, date 04.04.2049 on the file of the learned Chief Judicial Magistrate/Special Judge, Cuddalore.

2. This Court, by Order dated 04.04.2019 in Crl.O.P.No.8599 of 2019, while disposing of the petition had directed that the trial Judge, after completion of arguments by the prosecution, directed that the petitioner/accused shall complete the arguments within three days and thereafter the learned trial Judge shall ensure that the trial is completed at the earliest before 31.05.2019.

3. The learned counsel for the petitioner would submit that his counsel Mr.R.Dakshnamoorthy, has undergone surgery in the Eye due to blood clot and hemorrhage and also cataract in his eyes on 19.04.2019 at Dr.Agarwal's Eye Hospital and he has been advised for frequent administration of drops five times a day and to take bed rest for two weeks and he is aged about 71 years old, and therefore, the learned counsel for the accused in the trial Court is not in a

position to complete the defense witnesses by 03.05.2019. Therefore, he prays for extension of time limit to complete the examination of defense witnesses by A.D.JAGADISH CHANDIRA, J.

ssi ten days and that he will complete examining the defense witnesses on or before 13.05.2019.

Taking into consideration, the facts of the case and the submissions made by the learned counsel on either side, this Court is inclined to grant extension of time for a period of ten days from 03.05.2019. The petitioner shall complete examination of defense witnesses on or before 13.05.2019 and the petitioner shall complete arguments within three days after the arguments by the prosecutor. Thereafter the learned trial Judge shall ensure that the case is completed and judgment delivered on or before 31.05.2019. 30.04.2019 ssi
