ORDER
This Writ Petition has been filed challenging the order dated 20.03.2024 passed by the respondent, thereby directed the petitioner to
work in the place of G.Mariammal, Special Tahshildar (SSS), Madhavaram Taluk in pursuance of the ensuing General Elections to Lok Sabha 2024.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner had joined in the Revenue Service under the respondent on 17.07.2008 as Junior Assistant on compassionate ground. Thereafter, he was promoted to the post of Tahsildar and on deputation, he was worked in the Hindu Religious and Charitable Endowment in the office of the Assistant Commissioner, DPI Complex, College Road, Chennai, with effect from 01.03.2023. While being so, the respondent deputed the petitioner to work in the place of G.Mariammal, who is the Special Tahsildar (SSS), Madhavaram Taluk in pursuance of the ensuing general elections to Lok Sabha 2024 with respect to the Madhavaram Constituency and directed to report before the District Election Officer/Returning Officer, Tiruvallur District. However, the petitioner failed to report duty and he went on leave from
23.03.2024. As model code of conduct was in enforce from 13.03.2024, all the authorities under the State Government directly comes under the purview of Election Commission of India. However, the petitioner failed to report to duty. Therefore, the petitioner was served with charge proceedings under Rule 17(b) of Tamil Nadu (Disciplinary and Appeal) Rules. Now, he is facing the charges.
4. In view of the above, this Court finds no infirmity or illegality in the order passed by the respondent. Thus, the writ petition itself is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. Consequently, connected miscellaneous petitions are closed. No costs.
