Respondents Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for issuance of Writ of Mandamus, directing the respondents 1 and 2 to consider and pass orders on merits by disposing the written representation made by the petitioner on 13.04.2019 within a stipulated time. Ms.T.Girija, learned Government Advocate takes notice for the respondents 1 and 2; Mr.L.P.Shanmuga Sundar, learned Special Government Pleader takes notice fore the third respondent. By consent, this Writ Petition is taken up for final disposal.
2. The prayer in the Writ Petition is for issuance of Writ of Mandamus, directing the respondents to consider the representation of the petitioner, dated 13.04.2019.
3. According to the petitioner, the third respondent's husband has been acting as a President in the third respondentSociety and misappropriated several lakhs of Society funds, by https://hcservices.ecourts.gov.in/hcservices/
impersonating his wife's signature. Hence, he made a complaint to the respondents 1 and 2 on 13.04.2019. However, till date no action was taken. Hence, the present Writ Petition.
4. The learned counsel for the petitioner would submit that the petitioner would be satisfied, if a direction is given to the respondents to consider the representation of the petitioner.
5. The learned Government Advocate appearing for the respondents submitted that the representation of the petitioner, dated 13.04.2019 will be considered by the respondents within a time frame, as fixed by this Court.
6. In the light of the submissions made by the learned counsel on either side and also considering the limited scope of prayer sought for in this writ petition, this Court, without going into merits of the case, directs the respondents to consider the representation of the petitioner, dated 13.04.2019, and pass orders on merits and in accordance with law, as early as possible, preferably, within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, this writ petition is disposed of. No costs.
