O R D E R

The present petition has been filed to direct the respondents to register a case based on the complaint given by the petitioner dated 18.08.2015.

2. The petitioner herein lodged a complaint against one Sakthi alleging that the petitioner handed over a Diamond necklace to the said person on the assurance that he would return the jewel within a period of one month. But, subsequently he refused to return the diamond necklace. Hence, the petitioner lodged a complaint with the respondent police. Since no action was taken on the said complaint till date, the petitioner came forward to file this petition.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. The learned Additional Public Prosecutor has invited the attention of this Court to the letter dated 04.07.2015 given by Sakthi and Arul Ramesh to the Inspector of Police, Vadapalani Police Station and submitted that, the Inspector of Police has already conducted an enquiry and in the said enquiry, the counter petitioners had agreed to return the jewels.

5. The learned counsel for the petitioner submitted that though an assurance was given by the counter petitioners, till date they have not returned the necklace.

6.Considering the rival submissions, this Court directs the petitioner to give a fresh complaint to the first respondent along with a copy of this order within a period of one week from today and on receipt of such complaint, the first respondent is directed to conduct enquiry on the complaint and upon such enquiry, if materials are gathered indicating commission of any cognizable offence, the first respondent is directed to proceed further in accordance with law, as early as possible.

7. This criminal original petition is disposed of accordingly.
