The present petition has been filed to direct the second respondent to register a case based on the complaint given by the petitioner dated 09.10.2015.

2. The petitioner gave a sum of Rs.1,35,000/- to one of his co-worker Niranjankumar. Though the said Niranjankumar agreed to repay the amount, he did not repay. While so, on 23.08.2015, when the petitioner asked him to repay the amount, he refused to repay the money and also threatened him with dire consequences. https://hcservices.ecourts.gov.in/hcservices/

Hence, the petitioner lodged a complaint with the respondent on 09.10.2015. Since no action was taken till date, the petitioner came forward to file this petition.

3. Today, when the petition is taken up for consideration, the learned Additional Public Prosecutor submitted that the petitioner has already given a complaint on the same set of allegation and the respondent police, after conducting enquiry, closed the said complaint. Thus, he objected to give a direction. The Additional Public Prosecutor has also produced the closure report in respect of the earlier complaint for the perusal of the Court.

4. Since the second respondent has already closed the complaint, this Court is not inclined to give any direction. Hence, this petition is dismissed.
