ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 406, 420, 506 (ii) of I.P.C and Sections 4 (1) and 76 (1) of the Chit Funds Act, 1982, in Crime No.57 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and his wife are running a chit fund and collected Rs.13,85,95,000/- from 214 victims. Thereafter, they failed to return the amount. Hence, the complaint was registered as against the petitioner. 3.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and the second accused was granted bail on condition that she shall deposit a sum of Rs.10,00,000/-. He further submitted that the petitioner is ready and willing to deposit some reasonable amount as imposed by this Court and he prays for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor would submit that there are totally two accused in which the petitioner is arrayed as A1 and both the accused have collected nearly Rs.14,00,00,000/- from 214 innocent victims and cheated them. Now, the case has been transferred from the respondent police to E.O.W, Krishnagiri and the investigation is pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Considering the above facts and circumstances of the case and the petitioner had committed serious offence as against the society and have collected the amount and cheated the general public. Therefore, the petitioner is not entitle for anticipatory bail. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
