This application has been filed to condone the delay of 206 days in filing the written statement.

2. In the affidavit filed in support of the Judges summons, it had been stated that the copies of the plaint and other documents were received only belatedly and thereafter, owing to Ramzan Festival, instructions could not be given to file a written statement.

3. Taking into consideration the fact that the suit is for partition and all the parties should be afforded with an opportunity to present their views relating to the manner in which the properties are to be divided, the delay is condoned and this application is allowed.
