ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.08.2025 for the alleged offences under Sections 296(b), 115(2), 351(3), 232(1) and 118(1) of Bharatiya Nyaya Sanhita, 2023, in Crime No.450 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner attacked and intimidated the defacto complainant, who is an important witness in a murder

case pending against the petitioner and threatened him not to depose before the Court. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in the case and there was no such occurrence. It is further submitted that he has been in incarceration since 08.08.2025 and his health has deteriorated. The learned counsel would submit that he is ready to abide by any condition that may be imposed by this Court.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner is already an accused in a murder case involving the defacto complainant' s father and the present case has been registered for intimidating the witness. It is further submitted that the petitioner has 17 previous cases, out of which many are under Section 307 of Indian Penal Code, which clearly shows his criminal antecedents. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the submission of the learned counsel on either side, this Court is of the view that from the above factual position, the conduct of the petitioner clearly shows that he has been intimidating witnesses while on bail and is involved in serious offences. Considering the seriousness of the allegation, past criminal conduct and the fact that the petitioner is accused in the murder case of the defacto complainant's father, this Court is not inclined to grant bail to the petitioner.
