This petition has been filed to direct the respondents to investigate the above Crime No.527 of 2007 pending on the file of the fourth respondent and to file a final report within a stipulated time frame.
2. The petitioner has lodged a complaint as against one S.M.Jenil who is the Vice Chairman of M/s. Antony Logistics Pvt. Ltd., having office at No.36/2, 3rd Floor, Model School Road, Thousand Lights, Chennai-6 stating that the first accused/Jenil received some amount from the petitioner stating that he would arrange for contract for the petitioner with regard to the construction of houses for Tsunami victims but he did not arrange to get the contract for the petitioner. Hence, a complaint was lodged in the year 2007. Since no final report has been filed, the petitioner has come forward with the present petition to direct the respondent to file a final report.
3. When the matter is taken up for consideration, learned counsel for the petitioner submitted that though a complaint was lodged in the year 2007, till date, no final report has been filed. But the learned Additional Public Prosecutor replied that it was reported before the respondent police by the petitioner as well as the accused that the matter was settled between them and that was the reason for not proceeding further in the matter and now, they are prepared to proceed with the case in accordance with law.
4. In view of the submission made by the learned counsel appearing on either side, the fourth respondent is directed to investigate the case in Crime No.527 of 2007 pending on its file and proceed further in accordance with law and file a final report as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of this order.
5. The criminal original petition is disposed of accordingly.
