J U D G M E N T
The learned counsel appearing on behalf of the appellant made a submission that the issues between the parties to the present appeal suit has already been settled out of Court. In fact, in the EP proceedings, the amounts had settled as full and final settlement.
2. This being the fact brought before this Court, the learned counsel for the appellant also made an endorsement that the appellant is instructed the counsel to withdraw the present appeal suit.
3. This Court is of an opinion that no further adjudication is required and accordingly, A.S.No.541 of 2019 stands disposed of as withdrawn. However, the appellant is entitled for the refund of Court Fee, as the matter has been settled out of Court and the Registry is directed to refund the Court Fee by following the procedures. There shall be no order as to costs.
