O R D E R
The Writ Petition has been filed seeking a direction directing the 5th respondent to consider representations of the petitioner dated 24.09.2021, 16.02.2024 and remainder 01.04.2024 within a time frame.
2. The grievance of the petitioner is that, she is residing in the property bearing T.S.No.116, Old Survey No.13/2pt, Block No.15 measuring to an extent of 893 3⁄4 cents by acquiring a release deed in favour of her husband vide document No.2654 of 1995 dated 01.03.1995. However, the property was originally alloted by TNSCB now TNUHDB, Door No.67 Plot No.23 to an extent of 0.99.0 sq. mts. for the sale consideration of Rs.3860/- to be paid under 44.0 instalment basis and the said allotment was made on 20.06.1985. In the said circumstances, the 2nd respondent erected 440 watts electricity feeder pillar during the year March 2021, for which she raised objection, since the pillar was erected in her patta land. Thereafter, the Writ Petitioner has also made various representations to the higher officials, despite the 2/5
same, the 2nd respondent erected the same without her permission and without considering her objections. Hence, the present writ petition has been filed by the petitioner.
3. The photographs enclosed along with typed set of papers in page Nos. 50 and 51 would show that there is an imminent threat and there is live wires are there, which would cause threat to their life at any point of time.
4. On considering the facts and circumstances and also considering the main contention of Writ Petitioner stating that pillar is erected in the patta land of the petitioner, the 5th respondent is directed to consider the petitioner's representation dated 24.09.2021, 16.02.2024 and 01.04.2024 and to dispose the same on merits in accordance with law by affording an opportunity to the petitioner as well as by giving personal hearing and this exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
