ORDER
The applicant has filed this application to direct the respondent/AGOT to execute a lease deed in favour of Nadu Midwives and Nursing Council for a period of 50 years https://www.mhc.tn.gov.in/judis
and also to permit them to demolish and reconstruct the subject property.
2. It is brought to the notice of the Court that since no Nurses Club or Nurses Association was functioning in the said premises, the learned AG&OT had secured the possession of the property and it is at the disposal of AG&OT.
3. This Court vide order dated 03.10.2024, has observed that the property is a valuable one and the Trust is under an obligation to keep the property to fulfil the objects and since the said purpose could not be achieved, the AG&OT was directed to bring the property for public auction and to create a long term lease, so as to enable the Trust to get an optimum income. Learned AG&OT has also filed a detailed report dated 03.10.2024.
4. In the light of the order passed by this Court on 03.10.2024 and taking into account the report filed by AG&OT, nothing survives for consideration in the present application. Hence, this application is closed, however, this Court expects the learned AG&OT to consult a Property Investment Consultant and Public Works Department before arriving at the upset price for the subject property. 06-03-2025 ds https://www.mhc.tn.gov.in/judis
