( Criminal Jurisdiction ) Thursday, the Twenty Ninth day of July Two Thousand Twenty One PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.7178 of 2021 IN CRL OP.8301/2021 VIMAL KUMAR DANGRA [ PETITIONER ] Vs STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, C-2, ELEPHANT GATE POLICE STATION, (CR.NO.42/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed on him in Crl.MP.No.6336 of 2021 in Crl.Op.No.8301 of 2021 dated 18.06.2021 i.e .petitioner is directed to appear before the respondent police on every Monday at 10.30 am. until further orders and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of the case.
Order :This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.SELVAKUMARASWAMY, Advocate for the Petitioner and of MR.C.E.PRATAP Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- (The case has been heard through video conference) The present petition has been filed to relax the condition imposed on the petitioner in Para 4 of the order dated 18.06.2021 passed by this Court in Crl.M.P.No.6336 of 2021 in Crl.O.P.No.8301 of 2021.
2. This Court, vide order dated 18.06.2021 directed the petitioner to report before the respondent police on every Monday at 10.30 a.m., until further orders.
3. Learned Government Advocate (Crl.Side) submits that the petitioner has been complying with the conditions imposed by this Court.
4. In the above circumstances, this petition is allowed by modifying the condition that till filing of the charge sheet, the petitioner is directed to appear before the respondent police fortnightly ie., on 1st and 15th of every month at 10.30 a.m, and thereafter, the petitioner is directed to appear before the concerned court on each and every hearing dates at 10.30 a.m, until further orders. Except the above modification condition, all other conditions imposed by this Court in its order dated 30.04.2021 stand unaltered.
