ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 331(4) and 305(a) of BNS

Act, 2023 in Crime No.205 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he, along with other accused illegally trespassed into the medical shop run by the defacto complainant and committed theft of cash amounting to Rs.50,000/-. Hence, a case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has five previous cases against him. He further submitted that if the petitioner is enlarged on anticipatory bail, he would be emboldened to commit similar offences in future. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has five previous cases against him. It is amply clear that the petitioner has misused the liberty already granted by this Court, and if the petitioner is enlarged on anticipatory bail, he may be emboldened to commit similar offences in future. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
