Common Prayer: Contempt Petitions filed under Section 11 of Contempt of Courts Act, praying to punish the respondents for willfully disobeying the order of this Court dated 18.12.2023 in W.P.Nos.4971 of 2023, 4946 of 2023, 4977 of 2023 and 4968 of 2023.

(in all Contempt Petitions) For Petitioners : Mr.S.Vijayakumar For Respondents : Mr.K.Tippusulthan Government Advocate COMMON ORDER In continuation of my earlier order dated 12.07.2024, Mr.T.S.Selva Vinayagam, Director, Directorate of Public Health and Preventive Medicine (DPHS) and Dr.B.Baranidharan, Deputy Director of Health Service, are physically present before this Court.

2. The learned Government Advocate appearing on behalf of the respondents submitted that as against one of the Writ Petitions, out of the batch, namely, W.P.No.4938 of 2023, the Government had preferred a Writ Appeal in W.A.No.2486 of 2024, along with an application in C.M.P.No.17821 of 2024, wherein the Hon'ble Division Bench has granted an order of interim stay.

3. When the Hon'ble Division Bench has taken cognizance of the appeal and has proceeded with it, it would not be appropriate for this Court to parallelly proceed with the Contempt Petitions. However, if liberty is granted to the petitioners to workout their remedies, after final orders are passed in the Writ Appeal, a balance can be struck.

4. Accordingly, all these Contempt Petitions stand closed with liberty to the petitioners to workout their remedies subject to the outcome of the Writ Appeal in W.A.No.2486 of 2024.
