O R D E R
This petition is filed by the petitioner/husband to withdraw H.M.O.P.No.87 of 2017 filed by the wife from the file of Sub Court, Gudiyatham and transfer the same to the file of Sub Court, Salem on the ground that there is life threat by the respondent.
2.When this petition is taken up for hearing, the learned counsel appearing for the petitioner and respondent submitted that the parties have no objection to transfer H.M.O.P.No.87 of 2017 pending on the file of the Sub Court, Gudiyatham to the file of the Family Court, Vellore and they have also made an endorsement to that effect.
3.Recording the endorsement made by both the learned counsel for the petitioner and respondent, without deciding the issue on merits, the petition in H.M.O.P.No.87 of 2017 is ordered to be withdrawn from the file of the Sub Court, Gudiyatham and transferred to the file of the Family Court, Vellore. The learned Subordinate Judge, Gudiyatham is directed to transmit all the records pertaining to H.M.O.P.No.87 of 2017 to the file of the Family Court, Vellore within a period of two weeks from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/
4.Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. Consequently, connected Miscellaneous Petition is closed.
