Prayer: Writ Petition filed under Section 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Mandamus directing the respondents 1 and 2 to consider the petitioner's representation dated 06.07.2022 and consequently direct the respondents 1 and 2 rectify the mistake in measurement in patta No.338 issued in favour of petitioner with respect to the property in S/Nos.63/1A, 63/4A in Kaniyamoor Village, Kallakurichi.

ORDER

(1)This writ petition is filed to consider the petitioner's representation dated 06.07.2022 and to rectify the mistake crept in while issuing patta No.338 in favour of the petitioner with respect to the property in S/Nos.63/1A, 63/4A in Kaniyamoor Village, Kallakurichi.

(2)Mr.P.Balathandayutham, learned Special Government Pleader accepts notice on behalf of the respondents 1 and 2.

(3)There is no representation for the petitioner. Since the writ petition is disposed of at the admission stage itself, notice to the 3rd respondent is dispensed with.

(4)The learned Special Government Pleader appearing for the respondents submitted that the petitioner ought to have submitted an application for rectification through online. However, he made a representation through Registered Post with Acknowledgment Due and therefore, it has not been considered so far. He further submitted that the petitioner is having a remedy by filing an application through online for correcting the mistake and if any such application is made, the same would be considered by the respondents and appropriate orders will be passed. 2/4

(5)Considering the representation made by the learned Special Government Pleader appearing for respondents 1 and 2, this Writ Petition is disposed of with a direction to the petitioner to submit a fresh application for rectification through online within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application, the respondents shall consider the same after affording an opportunity of personal hearing to the petitioner as well as to the other interested parties, including the 3rd respondent and pass appropriate orders within a further period of eight weeks thereafter.
