This Criminal Original Petition has been filed to direct the Mahila Court, Chennai to number the Return of Property Petition filed under Sections 451 and 457 of Cr.P.C. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.

3.When the matter was taken up for hearing, learned Government Advocate [Crl. Side] submitted that the auto rickshaw involved in J-4 Kotturpuram PS Crime No.1257 of 2017 was initially produced before the IX Metropolitan Magistrate, Saidapet, Chennai. Therefore, when the petitioner filed a petition under Section 451 of Cr.P.C. before the Mahila Court, Chennai, the same was returned on the ground that auto rickshaw has not been produced before the Mahila Court. 4.Learned Government Advocate [Crl. Side] submits that now records have been forwarded to the Mahila Court, Chennai and therefore, there may not be any impediment for the petitioner to file a fresh application under Section 451 of Cr.P.C. before the Mahila Court, Chennai.
