O R D E R
This writ petition has been filed in the nature of a Mandamus, seeking a directing against the fourth respondent, Director of Adi-Dravidar Welfare, Chennai, to dispose of the petitioner's appeal dated 28.12.2022.
2.In the affidavit filed in support of the writ petition, it had been contended that the writ petitioner had served as a Superintendent in the Adi Dravidar Welfare Department and, subsequently, as a Deputy Tahsildar at the Headquarters of the Tahsildar Training Centre in Kurinjipadi, Cuddalore District. He had also undergone training at various locations. The petitioner was suspended from service by the fourth respondent for a period of six months and six days, from 02.08.2019 to 06.02.2020. It had been stated that monthly deductions were being made from his salary in relation to alleged amounts that had fallen short due to his various acts of omission and commission. 2/5
Furthermore, it had been contended that an appeal had been filed on 28.12.2022, which is currently pending before the first respondent. 3.If the appeal papers are available with the fourth respondent, the fourth respondent shall endeavour to dispose of the appeal within a period of four months from the date of receipt of a copy of this order. If the appeal papers are not available with the fourth respondent, the fourth respondent shall notify the petitioner accordingly. Upon such intimation, the petitioner may file a fresh appeal before the fourth respondent, treating it as a continuation of the earlier appeal dated 28.12.2022. In such an event, the fourth respondent shall be entitled to a further period of four months from the date of receipt of the fresh appeal to dispose of the same.
4.With the above observation and direction, the writ petition stands disposed of. No costs.
