ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 3(1), 3(2), 4(1), 5(1)(a) of ITP Act, 351(3) of BNS, in Crime No.160 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner is working as the Manager of a Spa, where illegal activities are alleged to have been carried on. Hence, the complaint has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner is involved in offences under the Immoral Traffic. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

6. Taking into consideration the totality of the circumstances and the nature of the allegations particularly involving offences under the Immoral Traffic, this Court is of the firm view that granting anticipatory bail to the petitioner, at this stage would not be appropriate, as it may send a wrong

message to the society. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
