ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, to direct the respondents to consider the representation of the petitioner dated 21.12.2020 addressed to the first respondent herein.

2. Heard Mr.C.Jagadish, learned counsel for the petitioner and Mr.N.Nithianandam, learned counsel for the respondents.

3. The petitioner is said to be working as an Additional Chief Manager at the first respondent Neyveli Lignite Corporation. The petitioner was transferred from Neyveli to Uttarpradesh Power Plant in the same post. The petitioner has stated that he has a sick mother who is 73 years old and has given a representation to the respondents to consider his personal circumstances and allow him to be placed at Neyveli itself.

4. However, the learned counsel for the petitioner submitted that even when the petition was taken up on 13.07.2021, the petitioner was advised to join duty in the transferred destination and then make a Page No.2 of 4

representation.

5. The learned counsel for the respondents submitted that the petitioner obeyed the earlier order and joined in the new station and he did not challenge the transfer order.

6. The petitioner had obeyed the order of the respondents and he has not opted to challenge the authority of the respondents in transferring him. But, his simple request is to consider his family circumstances and re-post him at Neyveli. Hence, I feel the respondents can take up the representation of the petitioner and consider the same and pass orders.

7. In the result, this Writ Petition is disposed and the respondents are directed to consider the representation of the petitioner dated 21.12.2020 and pass orders on merits within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
