J U D G M E N T
[Judgment of the Court was made by R.SUBRAMANIAN, J.] Both the appellant and the respondent are present in the Court and also filed joint compromise memo. In view of the said compromise memo there will be a decree in terms of compromise memo filed in support of this C.M.A.No.980 of 2018.
2. Accordingly, the Civil Miscellaneous Appeal is disposed of in terms of compromise. No costs. Consequently, Connected Miscellaneous Petitions are closed, if any. Note to Registry, the decree shall be drafted as follows:
1. The respondent shall pay a sum of Rs.37,50,000/- (Thirty Seven Lakhs and Fifty Thousand only) to the appellant as agreed to as shown in Clause 3(a) to 3(c) of the compromise memo. The appeal shall stand dismissed confirming the judgment https://hcservices.ecourts.gov.in/hcservices/
and decree of the trial Court.
2. In the event of failure to pay a sum of Rs.37,50,000/- (Thirty Seven Lakhs and Fifty Thousand only) as well as the maintenance of Rs.20,000/- as per the clauses 3(a) to 3(c) the appellant will be entitled to execute this decree as a decree for payment of money.
