Prayer: Petition filed under Article 226 of The Constitution of India praying to issue a writ of Mandamus, directing the first and second respondents to include the name of the petitioners in the Plot Watcher State Wide Seniority List so as to enable them to get the benefit of G.O.D.No.73, Environment and Forest Department dated 23.03.2017 thereby getting cadre post of Forest Watcher in the light of the proceedings dated 14.02.2013 of the conservator of Forest, Coimbatore and the same was received on 16.10.2015 by the 2nd respondent by considering the representation dated 15.05.2017 of the petitioners.

Mr.E.Manoharan, learned Additional Government Pleader, accepts notice on behalf of the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage itself.

This writ petition has been filed seeking for a direction to the first and second respondents to include the name of the petitioners in the Plot Watcher State Wide Seniority List, so as to enable them to get the benefit of G.O.D.No.73, Environment and Forest Department dated 23.03.2017, thereby getting cadre post of Forest Watcher, in the light of the proceedings, dated 14.02.2013, of the conservator of Forest, Coimbatore and the same was received on 16.10.2015, by the 2nd respondent, by considering the representation dated 15.05.2017 of the petitioners.

The learned counsel for the petitioners would submit that the petitioners are working as Plot Watchers on daily wages basis and their names have been recommended by the third respondent and included in the seniority list in his proceedings Na.Ka.No.g3/1436/2013, dated 14.02.2013. The Government has also issued orders in G.O.Ms.No.202, Environment & Forest-2 Department, dated 18.12.2013, to include the name of some of the Plot Watchers, who are working for more than 10 years on daily wages basis. The petitioners have submitted a joint representation dated 15.05.2017 to the respondents requesting to include their names in the State Wide Seniority list so as to enable them to get their service regularised.
4. The learned counsel appearing for the petitioners would further submit that the petitioners would be satisfied, if their representation dated on 15.05.2017 is directed to be disposed of, by considering the recommendation made by the third respondent as well as the order passed by the Government.
5. Recording the submission made, a direction is issued to the second respondent to consider the petitioners' joint representation dated 15.05.2017, taking into account the recommendation made by the third respondent as well as the order passed by the Government, and pass orders, on merits and in accordance with law, within a period of six weeks from the date of the receipt of the copy of this order and communicate the result to the petitioners.
6. This writ petition is disposed of accordingly. No Costs.
