ORDER

The petitioner apprehends arrest for the alleged offence under Sections 326(a), 303(2) of BNS 2023 r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.211 of 2025 on the file

of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joining hands with other accused illegally transported 3 units of river sand without any valid permission. On seeing the de facto complainant, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that 3 units of river sand had been illegally extracted from the river and that he has two previous cases, similar in nature pending against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has two previous cases of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
