O R D E R

This criminal original petition has been filed praying to direct the 2nd respondent-Police to register the complaint dated 08.09.2015 given by the petitioner and investigate the same in accordance with law.

2.The petitioner herein has lodged a complaint with the 3rd respondent-Police stating that 08.09.2015 he was assaulted by one Manoj Babu and Mathiazhagan with deadly weapons and he sustained grievous injuries all over the body; that immediately, he informed the same to the Police through phone call; that thereafter, the petitioner was admitted in Medawakkam Government Hospital and later, he was transferred to Government Hospital, Royapettah. The petitioner's complaint was received by the 3rd respondent-Police in C.S.R.No.787/2015. But, no action was taken on the petitioner's complaint. 3.When the matter is taken up for consideration, the learned Additional Public Prosecutor submitted that on the basis of the petitioner's complaint, a case in Crime No.3150 of 2015 under Section 75 of City Police Act, has already been registered by the 2nd respondent-Police.

4.But, the learned counsel for the petitioner submitted that the petitioner has been severely assaulted by the accused persons and that the respondent-police ought to have registered the case under severe offences.

5.However, the learned Additional Public Prosecutor submitted that during the course of investigation, if any other offence is made out, the same will be included in the final report.

6.In view of the submissions made by the learned Additional Public Prosecutor, there is no need to give any direction as sought for by the petitioner in this petition.
