This petition having been posted this day for being mentioned pursuant to the order of this Court date 08.09.2020 and made herein and in the presence of Mr.J.RAMESH Advocate, for the petitioner and of Mr.M.MOHAMED RIYAZ,Additional Public Prosecutor on behalf of the respondent, the Court made the following order. The matter is listed today under the caption for being mentioned.

2. The learned counsel appearing for the petitioner submitted that when the matter was listed earlier on 08.09.2020 the learned Additional Public Prosecutor submitted that petition enquiry in C.No.266 of 2020 is pending, whereas, it has wrongly reflected in the order dated 08.09.2020 that there is no petition or enquiry is pending. Accordingly prays for appropriate orders.

3. In view of the above submissions so made by the learned counsel for the petitioner, the order dated 08.09.2020 is to be read as follows:

"The learned Additional Public Prosecutor would submit that petition enquiry in C.No.266 of 2020 is pending.

2. The respondent police has to issue notice under Section 41 (A) of Cr.P.C., to the petitioner. The petitioner is directed to appear before the respondent police and the Investigating Officer has to conduct the enquiry by strictly following the procedures https://hcservices.ecourts.gov.in/hcservices/

therein. The Investigating Officer is to either register a First Information Report or close the complaint by 08.10.2020. If the Investigating Officer has grounds to arrest the petitioner, then he has to state the reasons in writing and communicate the same to the petitioner and in that case, the petitioner is at liberty to file necessary application before this Court seeking anticipatory bail.

3. With this observation, this Criminal Original Petition is closed."
