ORDER

The petitioner apprehends arrest for the alleged offence under Sections 332 (c), 75 of BNS r/w section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.15 of 2026 on the file of the respondent

police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner attacked the de facto complainant and abused in filthy language, due to which the de facto complainant sustained injury. Hence, this complaint.

3. The learned counsel for the petitioner submitted that the petitioner is also suffering from an ailment and sustained injuries in the present case. He further submitted that the petitioner was innocent and that he has been falsely implicated in this case and is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there is no change in circumstances in the present case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and upon the submission of the learned Govt Advocate (Crl.Side) that there is no change in circumstances in the case and also upon the further fact that the petitioner has not submitted any document in support of his ailment, this Court is not inclined to enlarge the petitioner on anticipatory bail. However, the petitioner is at liberty to file fresh application along with all material documents.
