ORDER

This writ petition has been filed seeking for a direction to the second respondent to consider the petitioner's representation dated 25.02.2025, to withdraw the Madambakkam Land Pooling Area Development Scheme.

2. The grievance of the petitioner in this writ petition is that even though an objection was raised by the petitioner to the second respondent as early as on 25.02.2025 requesting the second respondent to withdraw the Madambakkam Land Pooling Area Development Scheme insofar as the petitioner's lands are concerned, till date, the objection raised by the petitioner through his representation dated 25.02.2025 has not been considered by the second respondent.

3. Learned counsel for the petitioner also drew the attention of this Court to the Madambakkam Land Pooling Area Development Scheme and would submit that only in accordance with the draft scheme, the petitioner had given the aforesaid representation dated 25.02.2025 objecting to the lands of the petitioner being acquired. Learned counsel would also submit that the said representation was given within the sixty (60) days deadline fixed under the draft scheme.

4. Ms.C.Meera Arugmugam, learned Additional Government Pleader, accepts notice on behalf of the first respondent. Mr.B.Sanjay Balachandar, learned Standing Counsel, accepts notice on behalf of the second respondent.

5. No prejudice would be caused to the respondents if the petitioner's representation dated 25.02.2025 raising objections as per the Madambakkam

Land Pooling Area Development Scheme with regard to the acquisition of petitioner's lands is considered by the second respondent on merits and in accordance with law within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation dated 25.02.2025.

For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 25.02.2025 objecting to acquisition of the petitioner's lands under the Madambakkam Land Pooling Area Development Scheme after giving due consideration to the supporting documents produced by the petitioner within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
