O R D E R

The present criminal original petition has been filed to direct the respondent to register the case based on the complaint of the petitioner dated 01.09.2015 against the accused persons and take action against them in accordance with law.

2. The petitioner herein lodged a complaint as against one Prabakaran and Glory Prasanthi stating that the said persons borrowed a sum of Rs.10,00,000/- from the petitioner, for the development of their business. Subsequently, when the petitioner asked for return of the amount, they have not returned the amount. Hence, the petitioner lodged a complaint with the respondent police. But till date, no action has been taken. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. The learned Additional Public Prosecutor submitted that the matter appears to be civil in nature and thus opposed to give a direction as prayed for. He further submitted that on receipt of the complaint of the petitioner, C.S.R.No.468 of 2015 has been assigned and the matter is pending for enquiry.

5. In view of the submissions made on either side, this Court directs the respondent to conduct enquiry on the complaint given by the petitioner dated 01.09.2015 in C.S.R.No.468 of 2015 and dispose the same in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
