O R D E R

The present criminal original petition has been filed to direct the respondent to register the case on the complaint dated 19.08.2015.

2. The petitioner is the trustee of the Seemmadai Tanneer Pandhal, Asokapuram, Murugatholuvu Village, Chennimalai. The charitable inam was run by the Control of the temple which was administered by the Hindu Religious and Charitable Endowment. While so, one Babu, Rajendran and Sakthidaran by fabricating and manipulating the documents, sold the lands belonging to the above Charitable inam, in the name of 'Murugan Golden City' and 'Saravana Nagar'. In this regard the petitioner lodged a complaint before the respondent police. Though C.No.348 of 2015 has been assigned, till date no action has been taken on the said complaint. Hence, the petitioner has come forward with the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (Criminal Side) appearing for the respondent.

When the matter was taken up for consideration, the learned Government Advocate (Criminal Side) submitted a detailed enquiry was conducted on the complaint of the petitioner in C.No.348 of 2015 and thereafter, the said complaint was closed. He also produced a copy of the closure report before this Court.

5. In view of the submissions made on either side, as the complaint given by the petitioner has already been closed, nothing survives in this petition and this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
