CR.NO.12/AC/95/CCII Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed on the petitioner by this Hon'ble Court in Crl.M.P.No.4889 of 2016 by order dated 26.04.2016 in Crl.A.No.310 of 2016 pending on the file of this Hon'ble Court.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.NIRMAL KUMAR, Advocate for the petitioner and of Mr.E.RAJA, PUBLIC PROSECUTOR ( V & AC) on behalf of the Respondent the court made the following order:- The above petition is filed praying to relax the condition imposed upon the petitioner on 26.04.2016 in Crl.M.P.No. 4889 of 2016 in Crl.A.No.310 of 2016.

2. It is submitted by the learned counsel for the petitioner that the petitioner is a senior citizen, he is suffering from age related ailments and he is facing great difficulty and hardship, appearing before the trial Court on every 1st working day of every month.

3. Learned Special Public Prosecutor appearing for the respondent submits that the petitioner has been complying with the conditions imposed by this court without any default.

4. In the circumstances, this court is inclined to modify the order dated 26.04.2016 passed in Crl.M.P.No.4889 of 2016 in Crl.A.No.310 of 2016. Accordingly, the petitioner shall appear

before the Special Judge / X Additional Judge, Chennai at 10.30 a.m., on the first working day, once in three months, pending appeal. -sd/- 27/02/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
