4.Therefore, considering the averments made in the affidavit filed in support of the application and after hearing the learned counsel appearing for the applicant/third defendant, this application is allowed. 5.The learned counsel for the respondents 1 & 2 has submitted that written statement has been filed with the Registry. Registry is directed to take the written statement on file.
