ORDER
This petition has been filed directing the respondents to refund the Rs.10,00,000/- payable to the petitioner towards refundable security deposit in the account of the Petitioner Solar Power Plant HTSC.No.039534390095. 2.Heard the learned counsel appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself. 3.It is the case of the petitioner that the petitioner made an application to the respondent for establishment of 1 MW Solar Power Plant under preferential
tariff scheme as per TNERC's Solar Order dated 28.03.2018 and paid Rs.10 lakhs towards refundable security deposit. Even after commissioning of the said solar power plant which was also certified by the respondent vide letter dated 19.07.2023, the refundable amount was not paid by the respondents, for which he made a representation to the second respondent on 27.07.2023, however no order was passed till date and hence, the present Writ Petition.

The learned counsel for the petitioner submitted that this Court in an identical issue in W.P.No.46508 of 2025 on 27.11.2025 had passed an order, wherein it has directed the first respondent to refund the eligible amount to the petitioner with appropriate interest as provided in the contract, if there is no legal impediment, within a period of six weeks and prayed to extend the same benefits to the petitioner herein.

Considering the facts and circumstances of the case and in the light of the order passed by this Court as stated supra, there shall be a direction to the first respondent herein to refund the eligible amount payable to the petitioner with appropriate interest as provided in the Contract, if there is no other legal impediment in disbursing the same to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
