Respondents PRAYER : The Writ petition has been filed under Article 226 of Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 8 to consider the petitioner representation dated 19.01.2023 by granting necessary aid and police protection by the 8th respondent by enabling the petitioner for securing possession of property Plot No.1, in Vasanthapuram Layout, Arasankazhani Village, Sholinganallur Taluk, Chennai District, Comprised in Survey No.139, patta No.1470, as per patta, new sub-division survey No.139/28, measuring to an extent of 2903 sq.ft.

ORDER

The writ petition has been filed to issue a Writ of Mandamus directing the respondents 1 to 8 to consider the petitioner representation dated 19.01.2023 by granting necessary aid and police protection by the 8th respondent by enabling the petitioner for securing possession of property Plot No.1, in Vasanthapuram Layout, Arasankazhani Village, Sholinganallur Taluk, Chennai District, Comprised in Survey No.139, patta No.1470, as per patta, new sub-division survey No.139/28, measuring to an extent of 2903 sq.ft.

2.The case of the writ petitioner is that taking advantage of the similarity in the name, the property of the petitioner been knocked away by A9 & A10 creating a false document and his property was sold to R11 to R12. This was brought to the notice of the authorities, the sale deeds were cancelled, aggrieved by that, appeal was filed by those respondent and that statutory appeal also dismissed. However, to take repossession of the petitoner's property, the police is not providing protection. Hence, the present writ petition.

3.The learned Government Advocate appearing for the respondent 1 to 8 submits that the representation of the petitioner dated 19.01.2023 is under active consideration. On completion of enquiry, necessary protection will be given as per law and documents. He seeks two weeks time to complete the enquiry on the representation. 4.Recording the same, the writ petition is disposed of directing the respondent police to give adequate protection to the petitioner herein, if the title stands in the name of the petitioner.
