Respondents Prayer:- Writ petition filed under Article 226 of Constitution of India, seeking for a Writ of Mandamus, directing the Respondents to consider the Petitioner's representation dated 07.02.2019 and to survey the house property in survey Nos.473/3B, 473/4A, 473/5A, 473/6A, to an extent of 1296 sq.ft and vacant land in survey Nos.473/7A (1368 sq.ft) and 474/2A to an extent of 1332 sq.ft situated in Kalathur Village, Nemili Taluk, Vellore District as per the oral partition and mark the boundaries.

O R D E R

In pursuance of the earlier order dated 18.06.2019 passed by this Court, the Second Respondent has filed a report dated 09.07.2019 stating that the patta of the property sought to be surveyed stands in the joint names of the family members of the Ramasamy and that during the inspection of the property, the Petitioner did not produced any document showing partition between him and the Third Respondent and that he had represented that after effecting partition, he would give an application to carry out survey and measurement of property and apply for separate patta. As it has been stated in the report that if the Petitioner makes such an application, the same would be considered, Learned Counsel for the Petitioner seeks permission of this Court to withdrawn the Writ Petition with liberty to https://hcservices.ecourts.gov.in/hcservices/

resort to the same and he has made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
