Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the second respondent to register a case on the basis of the complaint dated 07.09.2015, pending on the file of second respondent. ORDER

This petition has been filed seeking a direction to the second respondent to register a case on the basis of the complaint 07.09.2015.

The case of the petitioner is that her only son Sahir Hussain went to his wife's house on 23.08.2015 and after that, he went to job, thereafter, he has not returned. 3.

The petitioner already lodged a complaint before the second respondent on 07.09.2015. However, no case was registered and there was no proper response. Therefore, again, on 10.09.2015, the petitioner gave a complaint through person to trace out her son. Even thereafter, no action was taken. Hence, the petitioner has filed the present petition. 4.

I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor. https://hcservices.ecourts.gov.in/hcservices/

Considering the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the respondent along with a copy of the order, within a period of one week from the date of receipt of a copy of this order and on receipt of the same, the second respondent is directed to conduct enquiry and to proceed further in accordance with law, as early as possible.

With the above directions, the Criminal Original Petition is disposed of.
