OP.No.325 of 2022 & OA.No.380 of 2022 & A.Nos.2654 & 2655 of 2022 KRISHNAN RAMASAMY, J., Today, when the matter is taken up for hearing, the learned counsel appearing for both the parties submitted that the dispute among the parties has been resolved by the parties amicably and a memo of compromise entered into between the parties. The said memo of compromise dated 01.09.2022 has also been produced before this Court.

2. Today, both the parties with their respective counsel are present before this Court.

3. The said Memo of Compromise dated 01.09.2022 are extracted as under:

"MEMORAMDUM OF COMPROMISE A. The petitioner and the respondent (hereinafter 1/5

referred to as the ''parties'') state as follows: B. The petitioner has filed the present petition seeking to be appointed as the guardian and custodian of the above named minor child.

C. That during the course of proceedings before this Court, the petitioner and the respondent amicably consent to the following terms and conditions regarding custody of the minor child.

Terms and Conditions:

1.The respondent agrees to hand over the permanent custody of the minor child to the petitioner /mother. 2.The respondent shall exercise visitation rights over the minor child every weekend from 03.00pm on Saturday to 07.00pm on Sunday. The respondent can pick up the child and take him outside the petitioner's house during this period, and drop the child at 7pm on Sunday. 3.The respondent will hand-over all the essential documents of the minor child, including Passport, Aadhar Card, School report cards, Medical records of the child etc to the petitioner within 10 days of signing this memorandum of comprise.

4.The respondent can take the minor child along with 2/5

him when he visits his native place during the minor child's school holidays, important family events, festivals, trips, and the dates of travel and travel plans shall be communicated to the petitioner in advance through email. The visitation shall be subject to the convenience of the child and his academic and extracurricular schedule. 5.The petitioner shall inform the respondent if she visits her native place during the minor child's school holidays, important family events, festivals, trips, and the dates of travel and travel plans shall be communicated to the respondent in advance vide email. 8.Any change to this memorandum of understanding shall be made only after written communication and consent by both the parties.

9.The present original petition may be disposed recording the terms and conditions of this memorandum of compromise.
