O R D E R

The Criminal Original Petition has been filed to expedite the trial pending on the file of the Chief Judicial Magistrate Court, Nagapattinam in S.C.No.135 of 2016.

2. It is seen from records, that on 1.05.2014 the petitioners were assaulted brutally by the respondent along with other accused, Viz. Nedunchezhian, Mani alias Subramanian, Karunanidhi and one known accused. There was a long standing enmity between the petitioners and the respondent as well as the assailants in respect of one temple which is in possession of the petitioners for the past 50 years. The petitioners lodged a complaint against the respondent before the Vettaikaranneruppu police station wherein the case in Crime No. 42 of 2014 came to be registered. The respondent also lodged a complaint on the same day as against the petitioners in the same police station which came to be registered in Crime No.43 of 2014. The Police investigated both the complaints and filed a charge sheet as against the respondent as well as other connected accused before the learned Judicial Magistrate Court, Vedaranyam.

Subsequently, the complaint was taken on file as PRC.No. 4 of 2016 by the said Court and thereafter, it was taken on the file by the Chief Judicial Magistrate, https://hcservices.ecourts.gov.in/hcservices/

Nagapattinam as SC.No.135 of 2016 and it is pending for trial.

3.Heard learned counsel for the petitioners and perused the material available on record.

4. Considering the above facts and circumstances that the Calendar Case is of the year 2016, this Court deems it fit to direct the Chief Judicial Magistrate Court, Nagapattinam in S.C.No.135 of 2016, to compete the trial within a period of three months from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
