O R D E R

The challenge in the writ petition is against the impugned proceedings issued by the first respondent Co-operative Society by informing the petitioner to pay the outstanding loan amount of Rs.1,62,497/-.

2. The preliminary objection raised by the counsel appearing for the petitioner challenging the impugned proceedings of the first respondent is not maintainable in view of the decision laid down by the Larger Bench of this Court in K.MARAPPAN VS. DEPUTY REGISTRAR OF CO-OPERATIVE SOCIETY, NAMAKKAL reported in 2006 (4) CTC 689.

3. Following the aforesaid decision, the writ petition stands dismissed as not maintainable. However, liberty is granted to the petitioner to seek remedy before the appropriate authority under Sec.90 of the Tamilnadu Co-operative Societies Act, within a period of eight weeks from the date of receipt of copy of the order. The interim order already granted by this Court shall continue till such period. No costs.
