In a proposed suit for recovery of money, this application is filed for leave to institute the suit against the second, fourth and fifth respondents before this Court. The applicant refers to the Bill of Lading and points out that the said Bill of Lading was issued at Chennai. Accordingly, it is stated that a part of the cause of action arose at Chennai.
2. Upon considering the said submissions and on examining the draft plaint and the documents, it appears that the cause of action has arisen at least partly within the jurisdiction of this Court. Accordingly, this application is allowed by granting leave to the applicant to institute the suit against the second, fourth and fifth respondents. As a corollary, the Registry is directed to number the suit if it is otherwise in order.
