O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences publishable under Sections 312, 419, 420 of IPc and r/w. Section 15(3) of Indian Medical Council Act, in Crime No.1032 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that, the de facto complainant Viz., Dr.Pankajam, Government Medical Officer on information has conducted the regular check up and found that the petitioner along with the other accused was running the illegal abortion clinic by using unregistered equipments for conducting scan on the pregnant women. Hence, the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. He further submitted that the other https://hcservices.ecourts.gov.in/hcservices/

accused have been arrested and thereafter released on bail. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Additional Public Prosecutor submitted that the petitioner along with other accused was found to run the illegal abortion clinic and thereby they have conducted several abortions for 4-5 month pregnant ladies by using unregistered equipments in violation of law endangering lives of several women. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and submissions of the learned Additional Public Prosecutor, this Court in not to grant anticipatory bail to the petitioner.
