Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to consider the claim of the petitioner for Unit Transfer from Corporation Service to School Education Service in the post of PG Assistant (Economics) by granting No Objection Certificate and permission for transfer by considering the representation submitted by the petitioner dated 09.02.2015. By consent, this writ petition is taken up for final disposal.
2. The petitioner is qualified with M.A. (Economics) and B.Ed., and she has participated in the recruitment process conducted by the Teachers Recruitment Board and she was issued with an order of appointment to the post of Post Graduate Assistant (Economics) in Chennai Corporation School by the second respondent, vide order dated 04.02.2013 and she joined in the said post on 08.02.2013. The petitioner would further state that she is the permanent resident of Rajapalayam, Virudhunagar District and her husband is running an Organic Store at Rajapalayam and she is having two children and in view of the present place of posting at Chennai, she is unable to look after her family and in this regard she has also sought for No Objection Certificate from the respondents so as to enable her to participate in the counselling for transfer to her native place, by submitting a representation dated 09.02.2015 and since she is yet to be favoured with any response, came forward with this writ petition.
3. Mr.G.Sankaran, learned counsel appearing for the petitioner would submit that the counselling for intra-district transfer is scheduled to be held on 23.08.2015 and taking into consideration the plea made by the petitioner, appropriate orders may be passed.
4. Heard Mr.S.Saravanan, learned Standing Counsel, who accepts notice for the respondents 1 to 3 and Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice for the fourth respondent.
5 Though the petitioner has prayed for larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the third respondent to consider and dispose of the petitioner's representation dated 09.02.2015 regarding the request made by the petitioner for grant of No Objection Certificate to participate in the counselling to be held on 23.08.2015 and pass orders on merits and in accordance with law on or before 21.08.2015 and communicate the decision taken to the petitioner, second respondent as well as to the fourth respondent.
