This Application has been filed to condone the delay of 56 days in filing the above captioned C.M.A against the decree and judgment passed in M.C.O.P.No.91 of 2016, dated 29.06.2022 on the file of the Motor Accident Claims Tribunal, IV Additional District and Sessions Judge, Thiruvallur at Ponneri.

2.Mr.R.Venkatesulu, learned counsel takes notice for the first and second respondents and submitted that he has no objection in allowing the above application.

3.Though notice was served on the third respondent, none had entered appearance on his behalf.

4.Heard both sides.

5.Considering the averments made in the affidavit filed in support of this petition and also the fact that the first and second respondent has no objection in allowing this petition and being satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for.

6.Registry is directed to number the C.M.A., if it is otherwise in order and the list the same on 31.08.2023.
